Critical formal gap. The contractor’s reference is PLN 600,000 net. The specification (in this sample: chapter V point 2.3) requires a single contract of at least PLN 650,000 net and expressly forbids aggregation. Clarifications (PZP art. 284) will not lower that threshold — the buyer would have to amend the specification.
Paths to a call within 48 hours:
- Request to amend the specification (ask to lower the threshold to PLN 600,000).
- Bid in a consortium, or rely on a third party’s capacity (PZP art. 118).
- Failing that — the call drops to No-Go.
Contract risks
1% of contract value per day of SLA downtime — RISK. That is not a selection criterion; it sits in the draft contract terms. Ask the buyer for a market-typical rate (0.1–0.2%) or an aggregate cap (e.g. 20% of contract value).
No ban on subcontracting key parts of the contract. Assignment-of-receivables clauses are standard; assignment is not the same as subcontracting.
The call, in plain language
Bid only if, within three working days, you close the reference threshold: either a positive amendment after the request, or a signed arrangement with a partner for third-party capacity / a consortium. Turnover, insurance and ISO 27001 pass. We will not invent the missing fifty thousand.
